Consumer Protection Regulations

Consumer protection legislation has become increasingly complex and far reaching, covering every element from entering into an agreement with vendor or landlord, marketing a property for sale or rental and forming a tenancy agreement.

It is, therefore, essential for all sales and lettings staff to be aware of the relevant law and, in particular, The Consumer Protection from Unfair Trading Regulations 2008 which directly govern agents’ relationships with clients, buyers and tenants.

This course looks at the law from both a sales and lettings perspective, advising on the right procedures to have in place, what is and is not permissible and the consequences of a breach.

The session will also include ASA rulings and CAP guidance on advertising. It will also explain the Consumer Rights Act and demonstrate how to write correct property descriptions.

Any property professional who wishes to develop their understanding of the laws protecting consumers.

  • The Consumer Protection from Unfair Trading Regulations 2008 (CPRs)
  • Property descriptions and how to get them right
  • The Business Protection from Misleading Marketing Regulations 2008 (BPRs)
  • Consumer redress schemes and Ombudsman claims
  • Distance and off sales and consumer cancellation rights
  • The Consumer Rights Act, fees, and display
  • ASA ruling and CAP guidance on advertising
  • Civil and criminal penalties for unfair trading
  • Unfair contractual terms and what is allowable
