Bribery Act 2010

The Bribery Act comes into force in April 2011.

The Act includes an offence of commercial organisations to prevent bribery; however there is a defence if the organisation can prove that it had in place 'adequate procedures'  designed to prevent persons associated with the organisation from bribing on its behalf.  The Ministry of Justice has been consulting on what are adequate procedures: http://www.justice.gov.uk/consultations/briberyactconsultation.htm
