This is a highly professional service for the impartial settlement of estate agency disputes which don't involve a clear breaking of the NAEA's Rules of Conduct.

Terms of Reference

This service is available to everyone. It avoids becoming involved in expensive and lengthy legal battles. The people or groups involved agree to be bound by the Mediator's decision. All decisions are kept private.

Recommendations

The Mediator has the power to recommend a total or partial refund of any commission, fee or other expense. However, it's made clear from the start that the service does not involve making arrangements for paying compensation. The Association believes these kind of disputes should be dealt with through the Courts.

How the Mediation Service Works

Each party involved in the dispute is invited to enter into a mediation agreement. A Mediator is then appointed from the Association's College of Fellows. These Mediators are senior members of the Association who each possess many years of experience in estate agency practice and procedures.

It is made clear to everyone that any outstanding fees or expenses will have to be paid in full. The Mediator can offer the facility for these payments to be made to the Association.
